Hon. David Proctor

Robert David Proctor (born December 5, 1960) is a United States district judge of the United States District Court for the Northern District of Alabama.

Education and Career

Born in Atlanta, Georgia, Proctor received a Bachelor of Arts degree from Carson–Newman College, (now Carson–Newman University), in 1983 and a Juris Doctor from the University of Tennessee College of Law in 1986.

He was a law clerk to H. Emory Widener Jr. of the U.S. Court of Appeals for the Fourth Circuit from 1986 to 1987. In 1987, he moved to Birmingham to take a position as an associate with Sirote & Permutt P.C. In 1993, along with two other attorneys, he founded the labor and employment boutique firm of Lehr, Middlebrooks & Proctor P.C.

He is an Elder at Briarwood Presbyterian Church where he teaches Sunday School, and serves as the Chairman of the School Board at Briarwood Christian School. He has also enjoyed coaching youth football, baseball, and basketball over the past twelve years.

Federal Judicial Service

On May 1, 2003, Proctor was nominated by President George W. Bush to a new seat on the United States District Court for the Northern District of Alabama created by 116 Stat. 1758. He received his commission on September 22, 2003.

Notable Cases

• 2021, Approved a settlement of $2.7 billion for people covered by Blue Cross plans between February 2008 and October 2020. Plaintiffs in the case claimed that Blue Cross plans divvied up territories to reduce competition in violation of antitrust laws. The lack of competition allowed some plans to charge higher rates for insurance coverage. Blue Cross plans involved in the case deny all allegations of wrongdoing.
